The data stored on the cloud will be primarily accessed by Atomberg’s engineering and data teams. The manner in which your information is collected, received, stored, processed, disclosed, transferred, dealt with and handled by such third-party site(s) is governed by the terms and conditions and privacy policy of the respective third-party site(s). We hereby expressly disclaim all liabilities with respect to the way the third- party site collects and/or uses your information. We will not disclose your information to third parties for their own independent marketing or business purposes without your consent. Your Personal Information may also appear in online searches. You should only share Personal Information with people that you trust because they will be able to save it or re-share it with others, including when they sync the Personal Information to a device.   • Affiliates: Your information may be shared amongst Atomberg’s group and affiliates.

Further, various security strategies are provided to effectively ensure data security of user and device. We comply with the IS/ISO/IEC 27001 standard on “Information Technology – Security Techniques – Information Security Management System – Requirements” as required under applicable law. In order to protect your Personal Information in line with the applicable data privacy laws and other regulations applicable in India, we have implemented appropriate technical and organizational measures. Please be aware that the transmission of information via the internet is not completely secure. Data Retention

We take reasonable steps to ensure that we retain information about you only for so long as is necessary for the purpose for which it was collected, or as required under any contract or permitted by applicable law Once the purpose has been fulfilled, your Personal Information collected by us will be deleted or anonymised in a secure manner, unless retention is required for legal, regulatory, or contractual purposes.

At any time, you may give, modify or completely withdraw your consent to us for collecting and processing your Personal Information. You may withdraw, modify or limit your consent at any time by going on ‘Settings’ on the Website / App and click on ‘Delete Account’ option or by sending a request letter for deletion of account on emailsupport@atomberg.com. This will delete all your personal data and anonymize your device-related data. We may, however, reserve the right to retain and store your Personal Information for our business purposes, whether such Personal Information has been deleted or not, to the extent permitted by law. Please note that your withdrawal of consent may result in us not being able to provide you with the services or terminate any existing relationship that we may have with you. We will inform you of any such consequences and make reasonable efforts to assist in the transition if applicable.

NOVA App Privacy Policy (DPDP-Compliant)

This Privacy Policy is issued by Atomberg Technologies Private Limited ("Company", "we", "us", "our") and governs the collection, use, disclosure, and protection of personal information through the NOVA App ("App"), effective as of November 03, 2025. By accessing or using the App, including its features for claim processing, Spin-the-Wheel programs, surveys, quizzes, KYC verification, and retailer tools, you explicitly consent to the practices described herein, in full compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and applicable Indian laws; continued use constitutes binding acceptance, and disagreement requires immediate cessation of App usage. The Company collects personal information directly from you or automatically during App interactions, encompassing your name, hashed Aadhaar number, encrypted PAN and bank/UPI details, phone number, email address, date of birth, KYC documents such as invoices, warranty cards, and fan images with barcodes or logos, location data including latitude-longitude coordinates, pin codes, and geo-status with your explicit consent (mandatory for antifraud and claims), device identifiers like encrypted IMEI (with consent), IP addresses, network types flagged for VPN or proxy usage, usage logs covering spins, points accumulation, redemptions, survey responses, claim histories, verification call timestamps and outcomes, fraud indicators such as image hashes for tampering detection, claim or redemption spikes, and hashed customer details, along with automatically gathered session data, login timestamps, and engagement metrics. Such information is processed solely for legitimate purposes, including validating and approving claims or redemptions, enabling Spin-the-Wheel point earnings and voucher issuances via in-app third-party microsites, conducting fraud prevention through blacklisting, geo-restrictions, spike monitoring, and tampering checks, performing verification calls and KYC assistance per scripted protocols, generating analytics for App improvements and performance metrics, delivering targeted marketing communications with opt-out options, ensuring regulatory compliance including audits and DPDP obligations, and utilizing submissions for intellectual property purposes such as marketing without additional compensation or consent. Your information may be disclosed internally to authorized Company personnel for sales, audits, and program management, or to trusted service providers like Botree Software International Private Limited for operational support, third-party microsites for redemptions, cloud storage vendors under encryption protocols, Area Sales Executives or Managers for escalations, voucher issuers, and legally mandated entities such as government authorities or courts in Mumbai with exclusive jurisdiction; aggregated or anonymized data may be used for analytics, but personal data is never sold, and disclosures occur only as necessary with safeguards. We implement robust security measures, including hashing for Aadhaar, encryption for PAN, bank details, IMEI, and sensitive files, strict access controls, regular audits, and consent-based location or device data collection, while retaining data only as required for operational, legal, or compliance needs—such as seven years for claims—with prompt deletion upon request or account closure subject to legal holds, and notification of breaches to you and authorities within 72 hours where mandated. Loyalty Program of Atomberg – Terms and Conditions

Last Updated: [10-1-2024] These Terms and Conditions ("Agreement") govern your participation in the Loyalty Program of Atomberg ("Program"). By accessing or using the Program, you (the "User," "Influencer," "Participant," "you," or "your") expressly agree to comply with and be bound by these Terms and Conditions ("T&Cs"). If you do not agree with any part of these T&Cs, you must immediately cease using the Program and uninstall the App.

1. Eligibility and Participation

  1. The Program is exclusively available to influencers who have been invited by an authorized Atomberg Area Sales Executive (“ASE”).
  2. Participation in the Program is contingent upon meeting all eligibility criteria specified by Atomberg and successfully completing the registration and KYC process.
  3. Atomberg reserves the right to, at its sole discretion, determine eligibility and disqualify any participant at any time without prior notice.

2 Registration and Login

  1. To participate in the Program, you must download the App and complete the registration process by providing accurate and complete information, including but not limited to your name, phone number, email, and pincode.

  2. You will be provided with an invite code, which must be entered, to log in to the Program.

  3. You agree to keep your account credentials, including login information and password, confidential. You are solely responsible for all activities that occur under your account.

  4. Atomberg and/ or its Authorized Personnel reserves the right to suspend or terminate your account if your credentials are found to be misused or accessed by unauthorized third parties. Such actions may result in the immediate revocation of access to all associated services, forfeiture of any pending rewards, and may further lead to legal action or penalties as per applicable laws and regulations.

  5. To the extent you are asked to click or check “I accept”, “I agree” or similar buttons or checkboxes in relation to this, doing so will be considered as providing your consent to process and have access to your personal data by Atomberg and Authorized Personnel, only in the countries where such consent is required by law. In all other countries, such action will be considered as a mere acknowledgement and the

  6. legal basis of the processing of your personal data will not be your consent but any other applicable legal basis.

3. KYC Verification

  1. You are required to complete the Know Your Customer (KYC) process by submitting certain identification details, including but not limited to PAN, Aadhaar, and bank details.

  2. You agree to provide accurate, truthful, and up-to-date information during the KYC process. Atomberg and/or its Authorized Personnel reserves the right to verify, approve, or reject any submitted KYC details at its sole discretion.

  3. If any KYC details are found to be falsified or fraudulent, your participation in the Program will be immediately terminated, and any accumulated points or rewards shall be forfeited.

  4. Atomberg, ASEs, and Authorized Personnel may review your KYC information for compliance purposes and for verifying your identity.

4. Points Accumulation


  1. Points will be awarded for valid claims as per the Program’s terms. Points are subject to review and verification by Atomberg.

  2. Atomberg and/ or its Authorized Personnel reserves the right to adjust, reverse, or cancel points if the claims are found to be invalid, fraudulent, or in violation of the Program’s rules.

  3. Fraudulent Claims: Any attempt to manipulate, falsify, or misuse claims will result in immediate suspension or termination from the Program, forfeiture of any accumulated points, and legal action if necessary.

5. Claims and Redemption

  1. You are responsible for ensuring that all claims submitted through the Program are accurate, valid, and comply with the Program’s rules.

  2. Any fraudulent activity, including but not limited to submitting false invoices, fake barcodes, or duplicate claims, will lead to immediate disqualification and the forfeiture of any points or rewards and you shall solely be liable to indemnify Atomberg and/ or its Authorized Personnel against all actions, proceedings, claims, liabilities (including statutory liabilities), penalties, demands and costs (including without limitation, legal costs), awards, damages, losses and/ or expenses however arising directly or indirectly as a result of any unauthorized access, fraud, misrepresentation, misuse or breach of the T&C contained herein.

  3. Atomberg and/or its Authorized Personnel reserves the right to cancel or refuse redemption requests if there is any suspicion of fraud or abuse.

  4. Redemption Limitations: Products are subject to availability, post redemption, and Atomberg and/ or its Authorized Personnel may modify, limit, or suspend redemption options without prior notice at its sole discretion.

  5. Atomberg and/ or its Authorized Personnel has the absolute right to alter the value of points, rewards, or available products in the redemption catalogue at any time, with or without any prior notice.

  6. All rewards are provided by the Authorized Personnel on behalf of Atomberg and shall, by Atomberg, be subject to deduction of TDS and other applicable charges, taxes, cess in accordance with the laws applicable in India.

  7. The rewards provided by Atomberg and/or its Authorized Personnel are only towards lawful and legally permissible activities.

Privacy and Data Use

  1. By participating in the Program, you agree to provide a free, specific, informed, unconditional, unambiguous, and an affirmative consent to the collection, storage, and use of your personal information by Atomberg and/ or its Authorized Personnel along with the user-generated content (UGCs), for the purposes of managing your participation, processing claims, and sending notifications related to the Program.

  2. Your personal information will be handled in accordance with Atomberg’s Privacy Policy. Atomberg and its Authorized Personnel will not be held responsible for any loss, theft, or misuse of your personal data by unauthorized parties.

  3. You may at any time, revoke your consent for collection, storage, and use of your personal information by Atomberg and/or its Authorized Personnel in writing by the prescribed mode of communication as per the applicable act, rules, guidelines as updated from time to time. However, pursuant to such withdrawal of your consent, you shall no longer be eligible for using the App and for participating in the Program.

7. Account Suspension, Termination, and Forfeiture

  1. Atomberg reserves the right, in its sole discretion, to suspend, terminate, or restrict your access to the Program without prior notice if: o You violate any provision of these T&Cs. o You provide false or misleading information during the registration or KYC process. o You engage in any fraudulent or abusive behavior related to claim submissions, points accumulation, or redemption. o Your conduct harms the integrity of the Program or Atomberg’s business interests.

  2. In the event of account suspension or termination, any unredeemed points or rewards will be immediately forfeited, and you will lose access to the Program without the possibility of reinstatement.

8. Intellectual Property

  1. The Program content, branding, trademarks including but not limited to “NOVA”, and all related materials are the property of Atomberg Technologies Private Limited, and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Program. You may not modify, distribute, reverse engineer or otherwise exploit any part of the Program or its content without prior written consent from Atomberg.

  2. The Nupi App (“App”) is licensed to Atomberg on a non-exclusive, non-assignable, non-sub-licensable and revocable basis by Nupi Infotech Limited. All Intellectual Property Rights of the App whether existing or derived shall solely and absolutely belong to and shall be governed/ owned by Nupi Infotech Limited (hereinafter referred to as “Nupi”) and/ or its Affiliates, any third party authorized by it (collectively “Authorized Personnel(s)”). Any infringement of its intellectual property and/ or any attempt to modify, duplicate, reverse-engineer the App or make any commercial benefits from the App is prohibited and in any such case, you shall be required to indemnify the Authorized Personnel along with any legal action that the Authorized Personnel and/or Atomberg may initiate against you.

9. Dispute Resolution

  1. Any dispute arising out of, or related to the Program, including these T&Cs will be governed by, and construed in accordance with the laws of India.

  2. You agree to resolve any disputes through binding arbitration in Mumbai, India, and waive any right to class action or collective claims.

  3. Atomberg reserves the right to seek equitable relief, including but not limited to injunctive relief, to protect its rights under this Agreement.

10. No Warranty & Limitation of Liability

  1. Atomberg makes no warranties or representations regarding the functionality, accuracy, or availability of the Program.

  2. You agree that your use of the Program is at your own risk. Atomberg and/or NUPI and/or its Affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your participation in the Program, including but not limited to loss of points, claims, or rewards.

  3. Atomberg shall not be responsible for any loss of data, unauthorized access to your account, or any technical failure that affects the operation of the Program.

11. Program Modifications

  1. Atomberg reserves the right to modify, suspend, or terminate the Program, or change these T&C, at any time, with or without any prior or subsequent notice. All changes to these T&Cs will be posted within the App and will be effective immediately upon posting.

  2. It is your responsibility to regularly review these T&Cs for any updates or changes. Continued participation in the Program after changes are posted constitutes your deemed acceptance and a free, specific, informed, unconditional, unambiguous, and an affirmative consent for such modifications/ changes including but not limited to any addition, deletion, amendment made thereto, whether or not in accordance with any required legal compliances by Atomberg and/ or its Authorized Personnel.

12. Indemnification

  1. You agree to indemnify, defend, and hold harmless Atomberg Technologies Private Limited and its Authorized Personnel, its officers, directors, employees, and agents from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to your participation in the Program or your violation of these T&Cs.

13. Governing Law

  1. These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes or claims that may arise under or in connection with these T&Cs shall be resolved in the appropriate courts located in Mumbai, India.

Acceptance of Terms : By participating in the Loyalty Program of Atomberg, you confirm that you have read, understood, and agreed to these Terms & Conditions. If you do not agree with any part of these T&Cs, you must immediately discontinue your participation in the Program.

NOVA Spin-the-Wheel Program (Points-Based Redemption)

This policy outlines the rules and regulations for the voluntary NOVA Spin-the-Wheel Program (hereinafter "Program"), a points-based redemption feature within the NOVA App ("App"). By participating, retailers ("Users" or "Participants") agree to these terms.


Validity:

  1. Applicable only in India (excluding Tamil Nadu).
  2. Open to Indian citizens (excluding Tamil Nadu residents).
  3. Program Period: 01/01/2025 to 31/12/2025 (or as extended/terminated by the Company).
  4. Participation is free and voluntary.

1. Program Description :

The Spin-the-Wheel is a gamified feature in the NOVA App allowing registered retailers to earn and accumulate points through non-monetary actions (e.g., surveys, quizzes). Points can be redeemed exclusively for vouchers via a third-party microsite, accessible only through the App. No cash or monetary prizes are offered.

2. Eligibility

  1. Open to residents of India (excluding Tamil Nadu).
  2. Participants must:
    • Be registered retailers with Atomberg Technologies Private Limited.
    • Have active access to the NOVA App.
    • Be 18 years or older.

3. How to Participate

  1. Access Spin-the-Wheel via the NOVA App.
  2. Earn spins by completing surveys, quizzes, or other App-based non-monetary tasks.
  3. Spins are rewarded at the Company's sole discretion—not guaranteed per task.
  4. One spin per eligible task/question.
  5. Spins cannot be purchased, transferred, or earned via payment.
  6. Random outcomes determine points awarded.

5. Intellectual Property
